Terms and Conditions
Read and follow all label instructions and, where applicable, Stewardship recommendations for use.
- Envu products must be purchased from an Envu distributor or retailer
- Envu product must be applied according to label directions.
- The Envu Performance Guarantee only applies to pest, weeds and diseases as listed on the approved label.
- The applicator must ensure full coverage of the target areas for control, following all requirements as stated on the label and, where applicable, in the Stewardship Guide instructions/recommendations. The applicator is responsible for any re-treatments as a result of misses, uneven applications and deviations from the label wording and application instructions.
- To determine if re-treatment is necessary, a field inspection shall be made by Envu and the user to determine the level of control and the final determination of performance will be at the sole discretion of Envu.
- Methods for determining control will include, but is not limited to, visual, remote sensing, as-applied map files and other sampling methods. Sampling techniques, sample number and sample size will be determined based on treatment area and other factors necessary to best determine the reason for poor performance.
- Poor performance, plant injury, other property damage and other unintended consequences may result because of the factors beyond the control of Envu. Those factors include, but are not limited to, weather conditions and any tank-mix partner effects or the manner of use or application. All such risks shall be assumed by the user or buyer.
- Should re-treatment be necessary, re-treatment must be performed by an Envu approved applicator. Once approved by Envu in writing, the re-treatment must be verified by providing a copy of the applicator invoice and spray application record to Envu. The re-treatment product will be provided directly to the owner (or spray contractor as determined by the release).
- Acceptance of re-treatment product, in addition to a signed release and settlement agreement explaining the desire to fully and finally resolve and settle all claims that were asserted or could have been asserted in regard to this complaint, shall be considered fulfillment of the obligations of this Envu Performance Guarantee. There is no further guarantee offered on re-treatment.
- Proof of purchase will be required in the event a customer raises a claim.
